Even if the judgment is reduced to the MICRA cap of $250, 000, that amount plus the economic damages of $188, 800 totals $448, 800, still exceeds the section 998 offer of $400, 000.

Moreover, when a defendant rejects plaintiff's §998 offer - pre and post offer costs are added to the verdict to determine if there was a more favorable verdict. In this case there are over $50, 000 in costs.

II MEDICAL OPINION TESTIMONY MUST BE TO A REASONABLE MEDICAL PROBABILITY

An expert witness - including a medical doctor - must testify on issues of the standard of care, causation and damages, in the field of his expertise, to a reasonable medical probability. Clearly, “[a]bsolute proof or mathematical demonstration is not required.” (Foremost Dairies v. Industrial Acc. Com. (1965) 237 Cal. App.2d 560, 568-569, citing Santa v. Industrial Ace. Com. (1917) 175 Cal. 235, 237.) However, an expert must testify to a reasonable medical probability as opposed to offering mere guess work, speculation, conjecture or bare possibilities.

Conversely, if the expert cannot testify as to a reasonable medical probability as to one of the elements of medical negligence - standard of care, causation, or damage - such testimony cannot be admitted. This fundamental principle that an expert must testify to a reasonable medical probability was stated in Rowley v. Bunnell (1968) 257 Cal. App.2d 324, where establishing the time of death of two testators was at issue:
“Medical witnesses need not testify positively to support a finding of proximate cause. Their opinion of-the probabilities is sufficient for that purpose.” (Emphasis added.) (Rowley, supra, 257 Cal.App.2d at p. 341.) See also Tannyhill v. Pacific Motor Transportation Company (1964) 22 Cal. App.2d 511, 521, citing to Travelers Insurance Company v. Industrial Ace. Corn. 22 Cal.2d 685. (See Robertson v. Leigh (1957) 153 Cal. App.2d 730.)

How Do You Define "Work Time" Anyway?

In order to know if the time you spend at work might be classified as overtime by the FLSA, you have to know how work time itself is defined. The FLSA language defining what constitutes work itself is vague enough, though, that each situation probably has to be figured out on a case-by-case basis.

For instance, in the 2005 US Supreme Court case of IBP Inc v Alvarez, the Court ruled that the time that employees spend walking to their production area after putting on required work gear is compensable. The time spent waiting to take the work gear off also is compensable. However, the time spent waiting to put the first piece of gear on before starting work is not compensable.

But all of this can be changed under a union or employee contract, if you’re under one, so, as always, make sure you read your employment contract carefully under any and all circumstances.

MEMORANDUM OF POINTS AND AUTHORITIES

I INTRODUCTION
This is a wrongful death action involving the death of Trevor Smith, who was a forty-one-year-old father and husband from Sacramento. He died of cardiac arrest following a lengthy period of multi-organ failure. Plaintiffs assert Defendants failed to properly diagnose and treat his condition.

Certain of defendants' expert witnesses in the pending case may testify to opinions on causation and the standard of care concerning the treatment. Some of the expert testimony may be couched in terms of “medical possibilities” rather than “medical probabilities.” California Evidence Code section 350 limits admissibility of evidence to “relevant evidence.” Relevant evidence is evidence “having some tendency in reason to prove or to disprove any disputed fact of consequence in the action”, that is, evidence that is probative of some disputed issue in the case. See Evidence Code section 210. Thus, evidence is irrelevant if it has a tendency to prove or disprove a disputed fact of consequence only by reason of drawing speculative or conjectural inferences from such evidence. On the basis of this definition, defendants' expert testimony may be irrelevant if it does not establish causation or the standard of care to a reasonable medical probability.

Section 352 of the Evidence Code permits the Court to exclude probative evidence if it is otherwise time-consuming, prejudicial, confusing or misleading. We are interested in medical probabilities, not possibilities, conjecture and/or speculation.

DAMAGES
As to Alexandra, the damage to his body speaks for itself. Plaintiffs presented substantial and credible evidence on this issue with the testimony of Dr. Peter W., Dr. Nathaniel T., Dr. Paul U., and Dr. Marilyn S.. All testified to the nature and extent of the severe and permanent injuries suffered by Alexandra, and Dr. W. testified to those things that Alexandra will need in the future by way of the life care plan.

Plaintiffs additionally presented substantial and credible evidence with Dr. David R. and Mr. Anastos concerning the nature and extent of Alexandra's disability as it related to his ability to work and the economic impact of that disability.

The jury obviously carefully considered the plaintiffs' expert witness testimony and the defense expert witness testimony and reached a compromise on the economic damages suffered by Alexandra. The award was reasonable and in line with the substantial and credible evidence produced by plaintiffs.

As to general damages, it was the jury's judgment that Mrs. Brown suffered $1, 000, 000.00 in general damages being witness to the injuries suffered by her child at birth and dealing with those injuries and their sequela.

Comparing the two lumbar MRI reports we see the difference. Following the attack by the dog Franz in 2006 the MRI records:

“A small amount of extruded disc material into the axillary portion of the canal on the left at this level, impinging on the left L5 root at its origin.”
This finding was not present in the earlier MRI.

This finding was also confirmed by Dr. Hambly in his operative report dated April 12, 2006, Dr. Hambly stated:

“Kerrie Rich is a 55-year-old attorney with a large disc herniation on the left at L4-5…there is a large high intensity zone within the substance of the L5-S1 disc.”

IV. FUTURE MEDICAL

As stated previously, Ms. Rich is still treating with Roseville Physical Therapy and with Richard Harty, P.T. Richard Harty’s March physical therapy will cost $360.00. Roseville Physical Therapy costs approximately $120.00 per visit; she is scheduled for approximately five more weeks with at least two visits per week. Therefore, the cost will be at least $1, 200.00.

On January 31, 2007, Ms. Rich was examined by orthopedic surgeon, Howard Shortley, M.D. In his report Dr. Shortley discussed in part Ms. Rich's condition and future medical:

“It is unlikely that Ms. Rich will improve in the future. Given her current age of 55 years, she is likely to grow worse over time. Because of this it is possible that she will require further back surgery.

Construction Company Fined for Lax Enforcement of Safety Standards

At the time Ms. Rich was examined by Dr. Shortley, it was Dr. Shortley’s opinion that surgery was “almost a medical certainty.” However, since that appointment Ms. Rich was examined by Praveen Mummaneni, M.D. with the Department of Neurological Surgery at UCSF. Dr. Mummaneni is recommending surgery. In his report it states:

“Assessment and Planning: The patient, who is a pleasant, 55-year-old right-handed woman presented to my office today at the UCSF Spine Center with complaints of postoperative low back pain radiating down her left leg. Her leg pain supersedes her back pain, and review of her postoperative lumbar MRI with and without contrast, as well as her lumbar CT with post-myelogram CT revealed a recurrent left L4-5 nucleus pulposus. Postoperatively the patient has failed conservative therapy in the form of formal physical therapy with injections. In accordance with the patient’s wishes, she wishes to undergo a reoperative left L4-5 diskectomy. I have gone over the indications, risks, benefits, and alternatives including death, and I have recommended that we obtain a new MRI with and without contrast prior to scheduling surgery. Once this is obtained, we will proceed with a reoperative left L4-5 microendoscopic diskectomy. In the interim, I have instructed her to notify me immediately should any problems arise beforehand that warrant my attention.

Ms. Rich has a pre-surgery consult and MRIs at UCSF on March 11, 2007. Dr. Shortley in his previously quoted report estimates the cost of future surgery to be $125, 000.00. Plaintiff will miss additional time from work.

VI. PUNITIVE DAMAGES

As discussed above, defendant, Paul Stevens, had already signed a document acknowledging the subject dog Franz was a vicious dog that had to be restrained. Despite this and with a conscious disregard for the safety of others, Paul Stevens permitted the dog to run free and attack Ms. Stevens.

We have sued Mr. Stevens for punitive damages. As you know, punitive damages, if awarded, must be paid personally by Mr. Stevens. It will not be paid by his insurance.

A failure by Allstate Insurance Company to settle this case will expose Mr. Stevens to financial ruin.

Post-operatively, Ms. Rich has not done well. She has continued to have left foot drop, right and left foot pain, weakness, and numbness. She has taken numerous medications to control her pain level. She had a lumbar MRI on June 4, 2006. She had a lumbar myelogram and lumbar CT on June 19, 2006. The lumbar CT showed the following impression:

“Status post left laminectomy defect at L4-L5. Small area of protrusion of the disks at the L4-L5 level on the left which appears to compromise the left L5 nerve root. This may represent a disk fragment extending posterior and inferior at the L4-L5 level on the left.”

A copy of the CT and myelogram are referenced herein.

Ms. Rich has undergone a series of treatments both before and after her surgery. Jeff Jones, M.D., has performed the following procedures on Ms. Rich:

April 3, 2006 “Epidural steroid injection.”
May 3, 2006 “Epidural steroid injection.”
November 2006 “transforaminal epidural steroid injection at theL5 neuroforamen of the left…a selective nerve root block”
December 20, 2006 “pulsed radiofrequency lesioning of the dorsal root ganglion and the L5 nerve on the left.”
January 17, 2007 “L2 left sympathetic block.”
January 23, 2007 “L2 lumbar sympathetic block on the left.”

Dr. Jones’ records are referenced herein.

Plaintiff treated with Roseville Physical Therapy. She was treated for over 50 visits with a reduced charge in 2006. As of 2007, Ms. Rich has been charged full price for her treatment. She is continuing treatment two to three times per week. Those records are referenced herein.

Sierra Ski Resorts Deal With Multiple Deaths And Tragedies

As it prepares to celebrate the 50th anniversary of hosting the Winter Olympics, a tight-knit Sierra Nevada ski community is mourning another loss in an unusual string of tragedies this season.

A skier's deadly collision with a tree Thursday at California's Squaw Valley USA resort is the latest in the series that involves two other skiers killed in avalanches and nine deaths in all.

Off the slopes, a shuttle bus crash killed a resort employee in April, and three young women hoping to get seasonal jobs died of carbon monoxide poisoning in December while sleeping in a car just outside the resort.

Extreme skier Shane McConkey of Squaw Valley died in March while jumping off a cliff with a parachute in Italy. And Dave Pedersen, the resort's race services director, died of cancer in February.

"To say this has been a year of tragedy is an understatement, " said Savannah Cowley, a resort spokeswoman. "It has been tragedies that have really, really struck our community. This is unprecedented as far as the grief this mountain has gone through."

Pete Bansen, Squaw Valley's fire chief, said he can't recall as many different kinds of fatalities in his 30 years in the resort community.

The avalanches – one killing ski patrol member Andrew Entin, 41, in March, and the other killing Randall Davis, 21, of Tahoe City, in December – were especially rare for Squaw Valley, he said. They were the first inbounds avalanche fatalities at the resort since 1963.

LIABILITY:
Regional Medical Center: Hospital nursing personnel fell below the standard of care in the following areas:

1) Regardless whether Ms. Cruz or the breech patient arrived at the hospital first, once the second of the two arrived, hospital nursing personnel had a duty to obtain a third OR crew, which would, at a minimum, have necessitated phone calls to obtain a third anesthesiologist STAT. Assuming that the second OR crew was called for Ms. Cruz, as was suggested by the timing of Dr. U.'s call to house supervisor Nurse F., an OR crew had not been called for the breech patient which, under the circumstances was below the standard of care. The hospital made no provision for two simultaneous Cesarean deliveries under circumstances in which a scheduled surgery had also been planned. There were three operating rooms in the main OR, but the hospital only had 2 OR crews. No calls were ever made to obtain a third anesthesiologist, who was then available.

2) Failure to transfer Ms. Cruz directly to the main OR with fetal monitor and L&D nursing personnel at 9:20 am, and to monitor the patient at that location until surgery could begin, thereby avoiding the delay of delivery which occurred between 10:52 am and 11:15 am.

Further, at 9:34 am, the FHR baseline was noticeably smoother than it was at 9:10 am, which failed to get the attention of L&D nursing personnel or to form an additional basis on which to prompt immediate transfer to the main OR. There is nothing in the chart indicating that Dr. U. was ever made aware of these changes of the FHR.

"The Board of Trustees was established under the Social Security Act to over­see the financial operations of the OASI and DI Trust Funds. The Board is composed of six members. Four members serve by virtue of their positions in the Federal Government: the Secretary of the Treasury, who is the Manag­ing Trustee; the Secretary of Labor; the Secretary of Health and Human Ser­vices; and the Commissioner of Social Security. The other two positions, which are currently vacant, are for members of the public, to be appointed by the President, subject to confirmation by the Senate."

As hard as I try, I cannot seem to understand how these two positions could be left completely vacant at such a critically important time, when now more than ever we need visionary leaders to guide us through difficult circumstances and an uncertain future. Who do we expect to look after our best interests if we ourselves will not? And how can we possibly hold politicians accountable for taking trillions of dollars from the Social Security trust fund when we the American people are denied our rightful advocates?

A Smile for a Suit

I never imagined that a set of clothes could put a smile on my face, but that was before I tried on my new suit.

Last Tuesday after work, I walked down to the Brook Brothers store located on LaSalle and Adams near the Chicago Board of Trade.

Almost every wall had wooden shelf cases with shirts stacked practically to the ceiling. And upstairs, it seemed like there were enough suits to clothe an entire town. After first trying on a dark navy jacket, I chose a two-buttoned grey, and a trim, white-haired man made small chalk markings on the fabric while he took measurements.

This expert tailor finished my suit today, and I picked it up this evening.

And as I was walking back, I realized that most of what I was wearing happened to be made right here in America. The suit I was carrying. The shirt I was wearing. My belt. And even my underwear. All had a “Made in the USA” label.

At that moment, in the light of the setting sun, I took satisfaction in completing a long day of hard work. Because I had given thought to my purchases, other Americans could also share in the pride of a job well done. And I smiled.

A Run-of-the-Premium-Coffee-Mill Recession?

I was working late tonight, and wound up leaving the office around 2:30 AM. When I got home, I decided to quickly check the news on CNN.com.

Earlier tonight, President Barack Obama appeared on television to plead the case for his economic stimulus plan, which would cost an unprecedented $838 billion, citing that this is not a "run-of-the-mill" recession.

However, the lead story on CNN.com was about Starbucks offering a coffee-breakfast combo to attract more customers in these trying economic times.

I can't help feel like the government, and the media, is increasingly out of touch with reality. While some might lead us to believe that current economic times are the worst since the Great Depression, the comparison seems hardly justified. Back then, devastating poverty, hunger, and homelessness affected millions of people.

It just seems like there's a big difference between being able to afford basic necessities versus not having enough extra money in the budget for premium coffee.

I'm not trying to make light of the situation, nor am I being cynical, but something just doesn't seem right here.

A Suitable Change

This morning (Saturday) I went down to the bank and purchased $200 worth of paper Series I bonds. Even though I've been doing a good job of saving lately, the amount of this investment is less than I would have liked. That's because I'm anticipating higher expenses for the month, as yesterday the company I work for tasked me with buying a business suit for an important upcoming meeting.

Believe it or not, I've never actually owned, or even worn, a suit before. Though I wear dress shirts on an almost daily basis, I typically roll up the sleeves within minutes of buttoning my shirt, and it's been so long since I've worn a tie that I've forgotten how to tie one.

And so, this week I'll set out to buy my first suit. I'm planning to look at one of the men's clothing stores in downtown Chicago, in search of a suit that fits both my frame and my budget.

Only three years ago, I could scarcely afford the cost of a new pair of jeans, and would stay up late stitching patches to repair the burns received from hot sparks of steel that sprayed upon me as I welded. Now I'm a position to enlist the help of a professional tailor.

Aside from this, I'm still a man working hard to accomplish his goals—that part hasn't changed. And while it's been said that clothes make the man, I believe that men are made by actions, not appearances. The strength of a warrior is found not in the breadth of his arm, but in the depth of his heart.

$700 Billion Bailout

This is not a corporation--it's a country! This is not of the corporation, by the corporation, for the corporation--it's of the people, by the people, for the people!

Earlier tonight, Congress came one step closer to passing a $700 billion bailout package for the financial industry. While I am not one to rush to judgment before knowing and understanding the details, my initial reaction is one of anger!

In fact, I am reminded of a drawing I made a few years ago, with the American flag depicted as a combination of corporate bar codes...

Regardless of whether the situation warrants a bailout or not, I firmly believe that the current credit crisis has been caused in part by the federal government. In addition to the constant manipulation of interest rates, continual federal budget deficits have vacuumed increasingly large amounts of capital from the credit markets, sucking up money that might otherwise be used for legitimate lending and productive business activity.

Tonight after work, I went to see the new documentary I.O.U.S.A.

The film focuses on what it identifies as the four major deficits in America: the federal deficit, the savings deficit, the trade deficit, and the leadership deficit. And while the subject of economics does not usually make for edge-of-your-seat excitement, I thought the presentation was very educational and engaging. I liked it!

i think it's stunning that the world, strongly aided and abetted by u.s. dollars and political support, continues to allow israel to engage in its 60+ year campaign to wipe palestinians off the map... i was right across the border from israel in jordan during the most recent gaza horror show and i could hardly believe the extent of what can only be described as the worst sort of war crimes that were being perpetrated against an entire population with no regard for women, children, the elderly, the sick, or the disabled... it was, simply, wholesale death and destruction both preceded and followed by an unending blockade of any and all goods and services necessary to even sustain life... what's happening in palestine is inexcusable and must be stopped and to support the efforts of a jewish-israeli mensch like ezra nawi is the very least we can do...

The man who drove his 20-year-old Mustang from Napoleon, Ohio, to Las Vegas and back last year on 39 gallons of fuel will open his first manufacturing facility Monday to allow others to get 110 miles per gallon.

Doug Pelmear, owner of Horse Power Sales.net Inc. and Hp2G LLC, will hold an open house Monday morning in the idle 100, 000-square-foot factory he has leased in Wauseon [Ohio] to begin manufacturing his revolutionary engine.

The factory, on the Fulton Industries Inc. campus in Wauseon, will be tooled to initially turn out 20 of Mr. Pelmear's custom engines per day with one shift of 25 workers.

A Decatur, Ind., specialty car company, Revenge Designs Inc., has contracted with Mr. Pelmear to purchase 2, 000 engines for use in a new vehicle it plans to unveil at the end of this year at the Los Angeles International Auto Show. The vehicle is to be called the Revenge Verde Super Car, which will use Mr. Pelmear's 400-horsepower engine and its 500 foot-pounds of torque to travel up to 200 mph and get 110 mpg - though admittedly not at the same time.

"The engine is going to be a really great partnership with the car, " explained Emily Levault, a spokesman for Revenge Design. "The idea behind this was to give people what they want while putting people back in their jobs."

Ms. Levault said the Verde will be introduced as both a left and right-hand drive, so that it can be marketed around the world. She said details of its pricing have not been released.

I Bought Some Stock Today

The stock market hasn't been doing too well lately.

I'm definitely not the biggest fan of investing in the stock market, but I bought some stock today. It seems like people are starting to panic, and stocks have been going straight down for a couple of weeks now.

This morning at work, I saw that the market opened way down (again) after Congress passed the $700 billion bailout last week. So I bought all I could while prices were in a near free fall.

I am an American. For richer or poorer, better or worse, this is my country--and Lady Liberty is my girl. I will do my part. If that means buying some stock and keeping my cool while others panic, then I'll buy some stock.

And that's exactly what I did.
